Mediation – A Practical Guide

Recent Legislation has created a role for mediation in the workplace. Employers have a legal duty to ensure conflict situations are resolved early. The Employment Act and in particular the new statutory ACAS Code of Practice on disciplinary and grievance management states that disciplinary and grievance issues need to be resolved informally.

Mediation is the 21st century way of examining differences and resolving disputes. It avoids the drawn out, costly and often adversarial alternatives provided by the courts or employment tribunals.

Conflict situations commonly occur in the workplace; nothing slows down progress faster than the delays associated with unresolved human resource issues. Solving these issues in a voluntary, non-confrontational and totally confidential and discrete manor by keeping the channels of communication open is one of the core factors in any successful business. Navigating those sometimes stormy waters can be perilous at best and disastrous at worst. The mediation process transforms conflict into creativity through open and honest dialogue. Mediation can be integrated into workplace provision; existing staff can be trained to mediate.

Resolving Disputes - The Law and the Mediation Process in Disciplinary and Grievance Management

Overview

The new framework for resolving employment disputes in Great Britain emphasizes the importance of the early resolution of workplace matters in the workplace. This new framework came into force on 6 April 2009. There are two key elements to this new framework:

  • Legislative Steps
  • Non-Legislative Steps.

This training programme will explore the new framework and how it can be effectively carried through in the workplace in two back-to-back sessions in one day, with a legal expert and an accredited mediator.
